ELRC CAUSE No. 877 OF 2018: 2017-2021 CBA NEGOTIATIONS
Further to our 2017-2021 CBA negotiation updates vide Internal Memo dated 18/09/2019, we are pleased to inform you that yesterday Monday, September 23, 2019 before Justice Maureen Onyango – Court No. 1, Milimani Commercial Courts, there was a Mention of the ELRC Cause No. 877 of 2018: 2017-2021 Collective bargaining.
During the session, the Salaries and Remuneration Commission (SRC) confirmed that it submitted beacons (guidelines) to IPUCCF on August 28, 2019.
On their part, IPUCCF informed the court that indeed negotiations were on-going and that; KUSU has been formally invited for negotiations slated for Wednesday September 25, 2019 at the Jacaranda Hotel, Westlands.
IPUCCF sought more time to conclude the said negotiations. Whereas, the Advocate appearing for IPUCCF requested the court to allow negotiations to continue and file its progress report in early December 2019, the Claimant Union and the Interested Party lawyers vouched to have negotiations concluded and progress report filed in October, 2019.
The Court finally directed that the matter be MENTIONED on the 20th November 2019 to report progress on negotiations and that if parties will not agree, then the Economic Report by the Central Planning & Monitoring Unit (CPMU) of the Ministry of Labour and Social Protection will be applied to give further directions.
To this end, I wish and hereby confirm that yesterday Monday 23rd September 2019, KUSU received a formal invitation to 2017-2021 CBA negotiations slated for Wednesday, September 25, 2019 starting 9.00 AM at the Jacaranda Hotel, Westlands in Nairobi.
This is therefore to update you, and to kindly request you to remain CALM and VIGILANT as parties amicably engage to resolve the dispute.
